Frequently Asked Questions
Effective and Timely communications About 5 years ago we started surveying our clients on how well we performed on their matter. One of the questions we ask is: Did we keep you properly informed of what was likely to occur in your matter?. To tell you the truth at first we did poorly. We made changes in the way we advise clients of what they can expect to occur in their matter and we now score highly on this question. Our website, in particular the going to court tour is testimony that we care about you being informed of what is likely to occur in your matter. You need to know how much your case is going to cost. We can guarantee that you will not leave the first appointment without being given an estimate of your legal fees or a fixed price quote. In the event that you decide not to use our services we will not charge you for the initial conference. Defence Investigation It is true to say that most cases are won or lost before you go to court. In trials winning minor points can make all the difference. Nothing can be taken for granted, especially scientific evidence. We have a range of tools that we know other criminal lawyers do not have, these include: * Sentencing statistics from Judicial Commission (cost $1200 per annum) * Sim card reader that downloads messages from sim cards so the evidence can be used in court. * Scientific measuring wheel that provides precise measurements at crime scenes. * Video enhancing software for enhancing CCTV and other video footage. This software not only allows us to produce clearer videos it also allows us to slow down the footage. Experience & knowledge of Magistrates & Judges We have 7 full time criminal lawyers who specialise only in criminal law. We have combined criminal law experience of more than 80 years. Our team includes: * An ex criminal law barrister with more than 28 years experience; * The author of a Criminal Law textbook The Local Court Criminal Practice * An Accredited Specialist in Criminal Law * A lawyer with a Masters degree from Cambridge in International Criminal Law * A former lecturer at University of Western Sydney * 2 Criminal law lecturers for the College of Law We keep notes on each court appearance and how the Magistrate or Judge dealt with an issue so we can learn how to approach the Magistrate or Judge in the future. Honesty We make it clear that we will not lie for our clients or make up defences. We know making a statement like that is likely to turn some people away from our firm, but at the end of the day do you want a solicitor who tells lies or one who you can trust. Each of our solicitors has been employed because of their character and their belief in social justice. Preparation For pleas of guilty, each of our solicitors have a thorough knowledge of what they are going to say, so that they can sell you before the court. Once you take your eyes off the magistrate, you give them permission to look down, stop listening and re read the police documents. For pleas of not guilty, you need to be ready to give evidence. While we cannot tell you what to say we can prepare you to give evidence. We can simulate a court room setting so that you understand what will occur and the types of questions you are likely to be asked when you are giving evidence. In jury trials, the jury members are making judgements about how you look and what you do or say. We will advise you on how you should behave while in court and we will give you tips on your physical appearance and body language. Strategy Our team includes 2 ex police prosecutor and 2 ex detective and acting crown prosecutor. Needless to say we know the best ways to approach a problem, how to deal with the police, when to negotiate and when to fight. We work as a team and will work hard to find a solution to your problem. We will not lie for you but we will do all that we can within the law to get the best result for you. Results At the end of the day the most important matter when choosing a lawyer is finding one who will get you a great result. We consistently achieve results that score in the top 5% of results recorded in the official statistics published by the Judicial Commission. We have won many criminal law trials where other law firms gave our clients no chance of success. We are happy to provide examples to individuals (excluding the press) upon request.
